  • INDUSTRY OVERVIEW

    The EU Battery Regulation (Regulation (EU) 2023/1542) mandates Digital Product Passports for industrial and electric vehicle (EV) batteries with a capacity greater than 2 kWh. These passports will be required from February 18, 2027, ensuring batteries meet stringent sustainability, safety, and transparency criteria.

    EU Battery Passport regulatory timeline:

    • August 17, 2023 – Regulation entered into force

    • February 18, 2024 – Regulation became applicable

    • August 18, 2024 – Substance restrictions take effect (limits on mercury, cadmium, lead)

    • August 18, 2025 – Due diligence obligations for responsible sourcing apply

    • February 18, 2027 – Mandatory Digital Product Passports for industrial and EV batteries over 2 kWh

    The Ecodesign for Sustainable Products Regulation (ESPR), which entered into force on July 18, 2024, mandates the development of Digital Product Passports to enhance product sustainability and circularity. For the tyre industry, specific requirements and timelines will be outlined in Delegated Acts, expected to be adopted in mid-2027. After adoption, an 18-month transition period is anticipated, making the Digital Product Passports mandatory between late 2028 and early 2029.
